More than 3.5 million federal employees must provide evidence to their employers by November 22 that they have received at least one dose of the COVID-19 vaccine or were granted an exemption under the President's September executive order.

The lawsuit filed on behalf of Jason Payne on Monday argued that the authorization was illegal and unconstitutional. It also pointed out that Payne has natural immunity to COVID-19 after being infected and recovering in 2020. Payne "refuses" the vaccination. As a result, according to the lawsuit, he has been promised to lose his job.

In an interview with Fox News, Hamilton said: "No matter how much the president wants to solve some specific problems... the desire to solve problems does not give the president the independent power to act." "In our federal government system, unless Congress takes other actions, Otherwise, the federal government has no power. So... his entire executive order to authorize vaccination of senior federal employees is based on the house of cards."

A senior government official told Fox News on Monday that 95% of the federal workforce meets vaccine requirements.

However, "there are still hundreds of thousands of employees" belonging to the remaining 5%, "there are no vaccinations nationwide." 

"This is still a very, very important thing, because it involves a large number of federal employees, and because this is an area where everyone from the president to the Biden administration is acting in a totally unlawful way, because they want something they want The desired result," Hamilton said.

Payne is still employed, but understands that under the guidance of the office, he may still be fired under Biden's executive order.

The U.S. Occupational Safety and Health Administration (OSHA) announced new vaccine regulations on November 4, requiring certain U.S. employers to ensure that all their employees are fully vaccinated by January 4, or test weekly and wear masks . 

On November 12, the Fifth Circuit Court of Appeals ordered the Occupational Safety and Health Administration to “not take any steps to implement or enforce the authorization until further court orders”. This decision is the first development in a protracted legal battle over the legality of authorization.

In addition, a federal judicial team has assigned the Sixth Circuit Court of Appeals in Cincinnati to handle more than 30 cases across the country that challenge the authorization. 

The Justice Department asked the Sixth Circuit Court on Tuesday to cancel the existing stay period and restore vaccine authorization for companies with more than 100 employees.

Since the beginning of the pandemic, 771,576 people have died of the virus, although this number is currently on a downward trend. Since January 1 this year, 386,233 people have died from the virus, compared with 385,343 last year. Nearly 60% of the U.S. population has been fully vaccinated.
